1. Non-Custodial Software
USA Wallet is a non-custodial, self-custody software interface. We do not hold, control, transmit, or have access to your funds, your private keys, or your recovery phrase at any time. All cryptocurrency assets remain in your sole custody on the underlying blockchain networks. You — and only you — are responsible for safeguarding your wallet credentials and authorizing any transaction.
Because we do not custody assets or transmit funds on behalf of users, USA Wallet does not operate as a money services business, money transmitter, broker-dealer, or exchange under U.S. federal or state law. We provide software, education, and a user interface for interacting with public blockchains and licensed third-party services.
2. Third-Party Services
Fiat-to-crypto and crypto-to-fiat purchases offered through the Interface are processed by independent, licensed third-party providers (including but not limited to MoonPay USA LLC and Transak USA LLC). These providers are the regulated money services businesses for any fiat transaction. USA Wallet is not a party to those transactions, does not handle the fiat funds, and acts solely as a directing surface that links you to the third-party provider.
Token swaps are routed through decentralized exchange aggregators (such as LI.FI). All swap transactions are executed on-chain by smart contracts and signed directly by your self-custodied wallet. USA Wallet does not custody the assets being swapped at any point.
Use of any third-party service is subject to that provider's own terms of service and privacy policy. We are not responsible for the acts, omissions, fees, exchange rates, or compliance posture of any third-party provider.
3. Educational Purpose
USA Wallet is offered as an educational and informational platform that empowers Americans to learn about and self-custody cryptocurrency. Nothing in the Interface constitutes investment, financial, tax, or legal advice. You are solely responsible for evaluating whether any digital asset, transaction, or strategy is appropriate for your circumstances.
4. Risk Disclosure
Cryptocurrency is a volatile, speculative asset class. The value of digital assets can fluctuate dramatically and may go to zero. You may lose some or all of the funds you allocate to crypto. Past performance is not indicative of future results. Smart contracts can contain bugs that result in irrecoverable loss of funds. Blockchain transactions are final and cannot be reversed by anyone, including USA Wallet, the recipient, or law enforcement.
Common risks include but are not limited to: market volatility, regulatory changes, technological failures, smart-contract exploits, phishing and social-engineering attacks, lost or compromised private keys, and counterparty failure of third-party services. You should only allocate funds you can afford to lose entirely.
5. Recurring Buy Reminders
If you create a recurring buy reminder in USA Wallet, you understand and agree that USA Wallet does not execute purchases on your behalf and does not hold or transmit any funds related to those purchases. Recurring entries are reminders only — at the scheduled time, you are deep-linked to the licensed third-party provider where you authorize and complete the purchase yourself. You may pause or cancel any reminder at any time. USA Wallet is not responsible for missed purchases, price changes between reminder and execution, or any provider availability issues.
6. Fees
USA Wallet charges a transparent partner fee on swaps and on fiat purchases routed through our integrated providers. The current rate is disclosed prior to every transaction. We do not earn money on your network (gas) fees, which are paid directly to the underlying blockchain validators. Third-party providers (MoonPay, Transak, swap aggregators) charge their own fees, which are also disclosed in advance. We may change our fee schedule prospectively by updating these Terms.
7. Acceptance of Terms
By accessing and using the Interface, you represent that you are financially and technically sophisticated enough to understand the inherent risks associated with using cryptographic and blockchain-based systems, and that you have a working knowledge of the usage and intricacies of digital assets such as bitcoin (BTC), ether (ETH), and other digital tokens. In particular, you understand that blockchain-based transactions are irreversible. You acknowledge that loss of your private keys or recovery phrase will result in permanent, unrecoverable loss of access to your assets and that USA Wallet cannot recover them for you.
8. Modifications
All modifications will be effective when they are posted, and your continued accessing or use of the Interface will serve as confirmation of your acceptance of those modifications. If you do not agree with any modifications to this Agreement, you must immediately stop accessing and using the Interface.
9. No Investment Advice
All information provided by the Interface is for informational purposes only and should not be construed as investment advice. You should not take, or refrain from taking, any action based on any information contained in the Interface. We do not make any investment recommendations to you or opine on the merits of any investment transaction or opportunity. You alone are responsible for determining whether any investment, investment strategy or related transaction is appropriate for you based on your personal investment objectives, financial circumstances, and risk tolerance.
10. Compliance Obligations
The Interface is not offered to any person residing in any jurisdiction where it is prohibited. It is your responsibility to ensure your compliance with all applicable laws, rules, and regulations.
11. Prohibited Activities
Fraud and Misrepresentation. Activity that seeks to defraud us or any other person or entity, including (but not limited to) providing any false, inaccurate, or misleading information in order to unlawfully obtain the property of another.
Intellectual Property Infringement. Activity that infringes on or violates any copyright, trademark, service mark, patent, right of publicity, right of privacy, or other proprietary or intellectual property rights under the law.
Cyberattack. Activity that seeks to interfere with or compromise the integrity, security, or proper functioning of any computer, server, network, personal device, or other information technology system, including (but not limited to) the deployment of viruses and denial of service attacks.
Any Other Unlawful Conduct. Activity that violates any applicable law, rule, or regulation of the United States or another relevant jurisdiction, including (but not limited to) the restrictions and regulatory requirements imposed by U.S. law.
12. Disclaimers
We do not warrant that the Interface will be accurate, reliable, complete, or current, or that the Interface will be free from errors, defects, viruses, or other harmful elements. No advice, information, or statement that we make should be treated as creating any warranty concerning the Interface. We do not endorse, guarantee, or assume responsibility for any advertisements, offers, or statements made by third parties concerning the Interface.
13. Class Action and Jury Trial Waiver
Any claim or controversy arising out of or relating to the Interface, this Agreement, or any other acts or omissions for which you may contend that we are liable, including (but not limited to) any claim or controversy as to arbitrability, shall be resolved by binding, individual arbitration. You waive any right to a jury trial or to participate in a class action lawsuit.
14. Dispute Resolution
If we aren't able to reach an informal resolution within sixty days of your email, then you and we both agree to resolve the potential dispute according to the process set forth below.
15. Data & Privacy
We collect only the minimum information needed to operate the Interface — primarily an email or social login for authentication via Privy, anonymized analytics about feature usage, and any optional contact information you provide. We do not sell or rent personal information to third parties. Wallet addresses and transaction data on public blockchains are inherently public and observable by anyone; we do not control that information.
By accessing and using the Interface, you consent to our data practices and the data practices of our service providers (Privy, Alchemy, MoonPay, Transak, Sentry, PostHog), each of which has its own privacy policy that we recommend you review.
